Couples to wed this summer balk at extra music fees | CTV News

The fees aren't large, but damn...

I thought the US was the only one that got to make messed up laws. Quit stealing our monopoly Canada!

Is this fee per song or per event? If the former it can get expensive fast. If the latter who decides which performer gets which slice? If you play all Bowie songs but one by AC/DC do they get equal shares? Do they need monitors or is there some sort of form for the playlist?

Retroactive?

It goes into a big pot which is then shared out annually.

As for crazy laws, we are catching up fast with our southern neighbours

Thanks. That just moves the problem though, how does anyone decide who gets what share of the pot?

Does the US have a stupid law like that? If so, I'm probably gonna break it this summer.

The US does have similar performance royalty laws, and 99% of DJs in SL break it hourly.

We have a similar system in the UK, and have done for almost 100 years. They don't normally charge, though, for things like wedding receptions unless (I think) the venue is charging you for providing the music, in which case they might, not unreasonably, to my mind, want a share.

I think that particular law is the very least of the laws regularly broken by SL DJ's. Hurry up and download your music before July 1 though!

That's not what that says at all.

Quote:
The program, commonly referred to as "graduated response," requires that ISPs send out one or two educational notices to those customers who are accused of downloading copyrighted content illegally. If the customer doesn't stop, the ISP is then asked to send out "confirmation notices" asking that they confirm they have received notice.

At that time, the accused customers will also be informed of the risks they incur if they don't stop pirating material. If the customer is flagged for pirating again, the ISP can then ratchet up the pressure. Participating ISPs can choose from a list of penalties, or what the RIAA calls "mitigation measures," which include throttling down the customer's connection speed and suspending Web access until the subscriber agrees to stop pirating.

The ISPs can waive the mitigation measure if they choose and not one of the service providers has agreed to permanently terminate service.
It's not that much more than what Comcast and Time Warner do now when they get complaints from the RIAA/MPAA.

No. And this tax is nothing new it's already existed in different forms, this is just an additional stacking of the same bloody thing. Canadians already pay an additional tax on recorded media ie: tapes, cd, and dvd, that's supposed to go to the artists. As well, recorded music companies that provide DJ's pay a royalty tax on the music. Got elevator music in your store...taxed....got it on your phone line.....taxed. Any community hall or similar venue that holds an event....yep...already taxed for music royalty. All they're doing now is adding an additional tax being levied on the end client. As to these fees being paid out to artists? Right....we all know how that goes.....it doesn't.

This will not end well. Oh sure, you can have it skip downloads from iTunes and what not, but what about all those independent artists out there that sell MP3s on their websites? Not to mention that people are already discussing ways around it.

Hmm, does this mean those ISPs would lose safe harbor status? Not sure what is in it for them to give that up.

Only 99%?

I would think clubs would bear some of that responsibility, as well.

Two differences:

1) Actions can be taken. That happens now to some extent if you load the network but it is usually an informal policy (and quite controversial).

2) It sounds like the ISPs decide when to take the measures based on packet monitoring, not a DMCA complaint from the copyright holders.

I am also not sure if the division that would be doing this would even have the right email address to contact me. Their billing department has the right one for me but I never use the email address that ISP gave me when I signed up for my connection. So what happens if I never receive the notices?

In RL yeah, on the internet not so much. The one supplying the music is the "performer" and is supposed to pay the royalties. Most DJs in SL have their own libraries, I don't think any venues supply them to the DJ. As such the DJ is supposed to be taking care of reporting. I don't think any of them bother, though.

If DJs did pay licensing fees, there's be a lot less of us. And those who did pay the fees would be demanding fees from clubs to cover those costs, which would lead to virtually no music except from live performers. It just wouldn't be worth it, considering most of us just do this as a hobby, and not for real life pay or anything.

Yeah, I'm one of the 99%.

On the other hand, there's a reason most of the stuff I play is out of print and obscure.

They don't send it to your email, they send it to the billing address.

My mother called me up frantically one day convinced that the FBI was going to arrest her because she got a letter from Bellsouth warning her that the "MACGYVER'S BEST EPISODES" she downloaded was copyrighted content and she might be liable for legal action if she continued downloading those types of files.
