There's got to be some sort of discretion somewhere. And why would a prosecutor WANT to charge somebody who was peeing behind a tree or in a back alley as though they were walking down broad street exposing themselves to random people? (..or whatever..) Doesn't that like.. take focus away from people who are doing really bad stuff?

Depends, I guess, what laws are at the prosecutor's disposal. Here, simply peeing against a tree or something would get charged as some sort of public order offence; for it to be exposure, the prosecution has to show intent to cause alarm or distress. As to high school sweethearts, we've got a -- to my mind -- unsatisfactory compromise in that, while their behaviour may well be illegal, it's Home Office and CPS policy that, under normal circumstances, prosecutions wouldn't be in the public interest.

But, ultimately, it's down to legislators (and the people who vote for them) to give prosecutors and courts sensible laws and some discretion, I think, otherwise you're bound to get situations that no one intended.

Why do you keep saying for the rest of their lives? Once they are off probation after serving their time, they get removed from the sexual offenders list. That happens in all but 2 states.

There are laws that are in place. Instead of supporting and defending underage teenagers who send naked pics of each other why don't you appeal that to our government?

Do you truly believe that these records will be completely removed from the net, that nothing is cached, that no searches will ever turn up positive? We all know that once something is out there, it stays out there.
As to supporting and defending teens who send naked pics of each other....I distinctly remember playing doctors and nurses with girls my age when I was a pre teen and yes...we touched each other!!

Does this make me a pervert, a rapist, a monster? Should I turn myself in now or is it only bad if it involves pics?

Yes, as far as services that rely on the national sex offender list. Take Indiana Sex and Violent Offender Registry for example. Offenders are added and deleted on a daily basis. Do you think offenders are added and others are never deleted?

You may have thought of it as "just playing doctor" but you both being so young you couldn't have realized how destructive that could be for the rest of your lives. What may not have affected you may have affected her.
