Justice Kennedy Announces Retirement

Supreme Court Justice Anthony Kennedy has announced he is retiring, and Trump and Congressional Republicans are practically slobbering all over themselves to name a right-wing replacement:

Just recently, SCOTUS just ruled in favor of Trump's Muslim travel ban, as well as siding with crisis pregnancy centers' omission of abortion option. If Trump can name Kennedy's replacement and get it through the Republican-controlled Congress before November, then it cements the Supreme Court as right-leaning for years to come.

Yeah, this is bad news. Really bad news.

A lot of people's rights are going to be eroded...women, LGBTQ+, minorities, consumers, workers, kids, anyone who doesn't identify as "Christian".

Maybe, someday, when Uzif loses that sweet health care system, or is otherwise negatively affected, and she will be, nobody is unscathed when democracy fails, she will see the light.

There's a lot of talk on the news about overturning Roe v. Wade.

While I don't trust the conservatives any further than I can throw them, most of the justices recognize "settled law" when they see it.

Roe v. Wade is settled law. It also has a majority of American public support. Only the whacko religionists seem to be peeing their pants over Kennedy's announcement. The same people who have been waiting for the 2nd Coming for 2,000 years.

He was appointed 30 years ago, and he's now 81 (I think). That seems an appropriate time to retire, and maybe he didn't think the situation merited changing his plans (and possibly breaking a promise to his wife, too). After all, at the end of the day, it's supposed to be up to the President to nominate supreme court judges and for the Senate to confirm them, or not, and if you're a Supreme Court justice I would imagine you have a powerful presumption in favour of letting the system work (or not) without trying to game it to achieve particular results, desirable though they may be.

He may also want to avoid having to spend his last years wrestling with nonsense about whether the President can pardon himself, which may well become an issue.

Kennedy is a partisan hack who agreed with the conservatives most of the time, just added his voice to one of the shittiest supreme court decisions of all time, and now wants to retire so that a conservative replacement is installed to make sure that his shitty legacy stays intact for the next several decades.

Of course he's retiring now.

Whatever else Justice Kennedy's decision to retire might be, I don't see how it can accurately be described as "treason" on any sober analysis.

I can see why people are so upset the judge is retiring but flinging around words like "treason" suggests to me that Trump's bad habit of describing anything he doesn't like as treasonous is catching.

124 US Supreme Court cases have been overturned by later Supreme Court cases. Some were long settled law - like Plessy vs. Fergusson was overturned 60 years later in Brown vs Board of Education. 60 years isn't the longest period of time between decision and overturn, I just knew the Plessy & Brown number.

Like Pace v Alabama (1883; law prohibited habitual cohabitation by two unmarried people of opposite sex, if one was black and the other was white. Pace declared that law constitutional) was partially overturned by McLaughlin v. FLorida (1964; law prohibiting unmarried habitual cohabitation of two unmarried people of opposite sex of two different races unconstituational) and later by Loving v Virginia (1967; among other things - laws prohibiting interracial marriage unconstitutional)

hmm. How to find where the Supreme court went backwards . . . hmms. . .

Abood v Detroit Board of Education (1977) allowed union fees in public sector; Janus v. American Federation of State, County, and Municipal Employees, Council 31 (2018) -
'The Supreme Court ruled that such union fees in the public sector violate the First Amendment, overturning the 1977 decision in Abood v. Detroit Board of Education that had previously supported such fees.'
