USA Gymnastics paid Olympian McKayla Maroney $1.25 million to keep quiet about years of sex abuse - ThinkProgress
Quote:
...

Maroney first brought her claims to USA Gymnastics in May of 2016, a few months after USA Gymnastics quietly let Nassar go and alerted the FBI to the allegations against him, and months before any of Nassar’s victims came forward. But the confidentiality agreement wasn’t signed until December 2016. Manly wants Maroney to be released from the nondisclosure agreement, and notes that in California, where Maroney lives, a victim of child sexual abuse cannot be forced to sign a confidentiality agreement as a condition of a settlement.

So far, the only person at USA Gymnastics who has lost his job amid the growing scandal is former president Steve Penny, who was one of the parties to sign Maroney’s NDA. Penny resigned in March, a full six months after the first reports about Nassar became public.

Earlier this month, USA Gymnastics filed a motion to be dismissed from a civil suit filed by victims of Nassar, saying it had “no legal duty to protect plaintiffs from Nassar’s criminal conduct” and “no duty to warn MSU, Twistars, or others about the reported concerns about Nassar.”

I was hesitant to even post this story in a sexual harassment thread. This is not harassment. This is sexual abuse and rape, involving minors in some cases. Whether we want to admit it or not, there is a huge difference between being an asshole or grabbing someone's ass or harassing them and committing rape against an unwilling partner, especially a victim who is underage.

Yeah that's pretty awful but standard defense stuff. I guess it's like "Responding to a lawsuit 101" says you throw every argument you can think of at the wall and let the judge decide which ones are valid and which ones aren't.

The whole Brief in Support of USA Gymnastics’ Omnibus Motion to Dismiss can be found here: https://drive.google.com/file/d/1Otq...tUCwR69Du/view

It claims there's a Michigan Supreme Court precedent to support the contention US Gymnastics had no duty to warn people about him. I can't really comment on this, though some of their propositions about this precedent and what follows from it sound a bit strange.

That doesn't mean it's impossible, of course, but it does make the law look rather odd if it is, in fact, as they argue it is.

How Tough Is It to Change a Culture of Harassment? Ask Women at Ford - The New York Times
Quote:
A multimedia exposé of the ongoing sexual harassment and misconduct toward women at Ford Motor Company. Despite numerous lawsuits filed and settled in the 1990s, a threatening culture has persisted and led to a new round of litigations. Reporters Susan Chira and Catrin Einhorn investigate whether that culture can survive the #MeToo revolution. What will it take to bring down male auto workers, managers, and union leaders who have harassed or violated women, in the way that they are being taken down in Hollywood, media, and the food world?

You could write something very similar about the US Armed Forces. Years now on from scandals like Tailhook and what has changed? Lots of classes but not much in the way of substance.

You can't grade harassment out of existence. The culture itself has to change.

And the problem with that is that it takes time, as in generations. Just ask....any black american. A Twitter campaign is not going to solve the problem, and I am going to come right out and say it. I am officially hesitant to support any movement that wants Rose McGowan as its self-appointed leader.

At least there is now a discussion going on, and that is as good a start as any.

She Broke Japan’s Silence on Rape - The New York Times
Quote:

The journalist, Noriyuki Yamaguchi, the Washington bureau chief of the Tokyo Broadcasting System at the time and a biographer of Prime Minister Shinzo Abe, denied the charge and, after a two-month investigation, prosecutors dropped the case.

Then Ms. Ito decided to do something women in Japan almost never do: She spoke out.

In a news conference in May and a book published in October, she said the police had obtained hotel security camera footage that appeared to show Mr. Yamaguchi propping her up, unconscious, as they walked through the hotel lobby. The police also located and interviewed their taxi driver, who confirmed that she had passed out. Investigators told her they were going to arrest Mr. Yamaguchi, she said — but then suddenly backed off.

So it looks like a whole lot of women indeed wore black to the Golden Globes, as planned.

A large number of men announced that they would also wear black tuxedos in "solidarity"; but I don't know how that's supposed to impress me, because isn't that what 90% of men attending the Globes and other industry award pageants wear every time anyway?

Unless they wore black shirts and accoutrements as well? I don't have TV, and haven't really been unbusy enough to tune in [honestly, never do anyway, but....]

Nope, classic tuxes with white shirts. If you didn't know some people had intended it to "mean something" you wouldn't even notice - and it's impossible to tell which of the men is wearing a tux because of solidarity, and which are wearing a tux because it's what they always wear to events of this kind.

Presumably, that's why they were wearing "Time's Up" lapel pins.
