How do you plan to fight a company that no longer cares about its long time residents that helped to build whatever the hell Second Life has become?

Speaking of which, Is there any other way to cash out Lindens using anything other than the Lindex? If I remember correctly, SLexchange used to... don't know if they still do. IGE sucked. Gom got GOM'ed...

Well one way is to not just throw up your hands and give into it and change the name. It is worth protesting and putting up a fight for. I would actually happily dump the SL name altogether as it is meaningless to me anymore. However, I am going to do it on my terms, not theirs. This site has been in compliance with their rules since its beginning in 2003, in fact I cleared the name before registering it.

Philip, Robin and others have participated in it. Torley Linden has thousands of pictures on Snapzilla. To claim now that the name is in violation is not only insulting an preposterous, but I doubt it can even stand up to legal scrutiny. It is like they came up with the two noun rule just to purposely punish existing sites. If the want to come after sites supporting them, let them do it - I certainly won't be quiet about it when they do.

A legal opinion would be interesting. I'm also not sure what the two noun distinction achieves for them, in terms of protecting their trademark.

First you have to get beyond the form letter response they insulted Flipper with.

Everything about this bullshit "enforcement" of the "Trademark" makes the baby Jesus cry.

LL has given implied and express consent for the URLs to so many websites it's not even funny. A Linden approached me, and asked me if they could put my blog on their fan site listing.

I said, "Sure, it's http://slrosie.com."

Five minutes later, I appeared on the SL website. I didn't ask to be put there, they asked to include me.

Can't un-imply your consent, LL.

Upsetting the grassroots PR will just eliminate the grassroots PR. But they do have quite a deal going, don't they? We pay to use their borked grid and virtual world, and they pay us nothing to publicize it.

I'll be removing the words "second" and "life" from my blog header, but they can bloody well pay me for the domain that they implied consent for if they expect me to move it.

(It doesn't stand for second life rosie anyway, though, of course. I'm hosted on my friend Isadora's server, so I'm a subdomain of skatoolaki.com ... so clearly, it's SkatooLaki Rosie.)

Ok, so I have not been paying attention to this. Do I need to remove

www.secondlifenow.com

??

I really Don't care if so. I have not updated that site in over a year. This will force me to do something new.

Yes, that domain was already in violation anyway - second life has been trademarked the whole time. They just didn't do anything bout it.

I am least encouraged that the vast majority of blog posts seem to get it - that this SL thing especially is just a major joke, and that the response from LL has been typically stupid. I also love how frequently the new inSL logo is bashed.

Ok, well really I see nothing on the website about URLs. I don't think they can just make me stop using a URL. THe text that it leads to is all they can have some control over.

Nevermind I found it.

This is OK:
DellSL.com
Dell-SL.com
DellinSL.com
SLArchitecturalDesignServices.com
SLADS.com (acronym for SL Architectural Design Services Inc.)

This is NOT OK:
DellSecondLife.com (can't use "Second Life")
Dell-SecondLife.com (can't use "Second Life")
SLArchitecture.com (must use at least two generic nouns with "SL")
SLDesign.com (only one generic noun; must use at least two)

If you've registered your own word mark or your name with two or more generic nouns as a second-level domain name, you may use "SL" or "inSL" as the subdomain or third-level domain, which is the part of the domain name before the second-level domain. You may also use "SL" or "inSL" in the URL path after your domain name. For example,

This is OK:
http://inSL.Dell.com (domain name with the Dell word mark)
http://SL.Dell.com
http://www.Dell.com/SL
http://www.Dell.com/inSL
http://inSL.ArchitecturalDesignServices.com (domain name with two generic nouns, "Design" and "Services")
http://SL.ArchitecturalDesignServices.com
http://www.ArchitecturalDesignServices.com/SL
http://www.ArchitecturalDesignServices.com/inSL

No Trademark or Business-Name Registration. Never

Beau, your domain has always been in violation. You can't use trademarked names in a domain name, and second life is trademarked, and was at the time you registered the domain.

The only thing you could potentially do with it is make it a site about being a born again Christian - achieving a second life, so to speak. As long as it has zero do with the SL itself, it would not be in violation most likely as the words are generic and would not cause confusion in that case. Also, I would not put too much concern into it - they have bigger fish to fry using second life in their domain names. I also have a feeling this domain name thing is going to turn into a PR nightmare for them - I am surprised they are not asserting claim on the word second as well.

It would be short-sighted of them to think they'd have a business without us; but they know, beyond any shadow of doubt, that we'll continue to support them with monthly tier no matter what they do.

Considering the past few years, it would be short-sighted of us to expect any reasonable treatment from Linden Lab as long as we remain their faithful customers. In fact, it's the very definition of insanity.

Comply, don't, sue us, we'll notify you, drag it out, all in a day's work, we dont' really care how it all falls, just keep paying that tier.

More highlights from the blog posts:

See post #92 on the blog by Gigs Taggart, regarding something interesting called estoppel by laches, a legal defense against LL doing this.

See post #108 by Lyselle Munro for fabulous common sense.

And as an aside, I love this, post #112, by Raul Crimson:

“If we consider ToS as a contract, then it is a really non reliable one. One of the parts of the contract can change it whenever he wants and the other part have to accept it of lose all HIS assets. Interesting.

I also like post #124, by Neural:

“Being that LL now sees the ToS as a contract, acceptance of the terms when you log on is acceptance of that contract. LL doesn’t need to take anyone to court, they will simply terminate your account and it will be up to you to take legal action against them.

"This is a sick sick thing to do to the users and they are gloating about it. Few if any of us will have the money to take Linden Research to court if they axe our accounts for the slightest violation.”

He tells it like it is.

I got the automated form letter as well.

Personally, I'm taking it as just that: an automated form letter, sent out automatically so I'm not sitting there wondering whether LL received my email or not. Its basically just a restatement of what the knowledgebase says on the subject.

I'm not going to officially freak out until one of two things happens:

a) 4 weeks elapses with no response

-or-

b) I receive a human-written email from Linden that my website violates their trademark, and no waiver will be given.

I'm holding out some hope that the definition of "strategic to our buisness" will be given a wide berth, and saving myself some mental energy in the mean time

Well I am taking down my site and I just purchased a new URL. I am going to redirect my currecnt one to a simple link that leads to SL. Maybe I'll get a referal or two.

If they have an issue with that, they can kiss my ass. I just spent money to abide by their new business philosophy.
