To claim now that the name is in violation is not only insulting an preposterous, but I doubt it can even stand up to legal scrutiny. It is like they came up with the two noun rule just to purposely punish existing sites. | Everything about this bullshit "enforcement" of the "Trademark" makes the baby Jesus cry. LL has given implied and express consent for the URLs to so many websites it's not even funny. A Linden approached me, and asked me if they could put my blog on their fan site listing. I said, "Sure, it's http://slrosie.com." Five minutes later, I appeared on the SL website. I didn't ask to be put there, they asked to include me. Can't un-imply your consent, LL. Upsetting the grassroots PR will just eliminate the grassroots PR. But they do have quite a deal going, don't they? We pay to use their borked grid and virtual world, and they pay us nothing to publicize it. I'll be removing the words "second" and "life" from my blog header, but they can bloody well pay me for the domain that they implied consent for if they expect me to move it. (It doesn't stand for second life rosie anyway, though, of course. I'm hosted on my friend Isadora's server, so I'm a subdomain of skatoolaki.com ... so clearly, it's SkatooLaki Rosie.)

As long as it has zero do with the SL itself, it would not be in violation most likely as the words are generic and would not cause confusion in that case. Also, I would not put too much concern into it - they have bigger fish to fry using second life in their domain names. I also have a feeling this domain name thing is going to turn into a PR nightmare for them - I am surprised they are not asserting claim on the word second as well. |

One of the parts of the contract can change it whenever he wants and the other part have to accept it of lose all HIS assets. Interesting. I also like post #124, by Neural: “Being that LL now sees the ToS as a contract, acceptance of the terms when you log on is acceptance of that contract. LL doesn’t need to take anyone to court, they will simply terminate your account and it will be up to you to take legal action against them. "This is a sick sick thing to do to the users and they are gloating about it. Personally, I'm taking it as just that: an automated form letter, sent out automatically so I'm not sitting there wondering whether LL received my email or not. Its basically just a restatement of what the knowledgebase says on the subject. I'm not going to officially freak out until one of two things happens: a) 4 weeks elapses with no response -or- b) I receive a human-written email from Linden that my website violates their trademark, and no waiver will be given. I'm holding out some hope that the definition of "strategic to our buisness" will be given a wide berth, and saving myself some mental energy in the mean time |
