I didn't see anything in her post that said to give up "easily". She just made the point that merchants have different financial situations. Therefore, the decision to take it all the way to court isn't a black and white one for every merchant.

That being said, I appreciate Eku for putting out some real world numbers. No matter where you stand on the issue, I think the most important thing is for current and future merchants to be informed about what they are realistically getting in to when it comes to all levels of the DMCA and court process. Then, they can make the ultimate decision for themselves based on their finances and support system.

I also found a public example of a skin designer readily securing considerable funds for legal action: see "One Voice".

Now that I have the impression of the shop actually being larger than I first guessed, I think the loss of income, if items aren't restored, will be the bigger financial hit. Notice how that suggests someone might actually make decent money without saying it directly. I'm learning the art of subtelty but I won't have mastered it until I can spell it.

You know, it's entirely possible Gala did nothing because she knew it was a baseless accusation and never in a million years thought that LL would take her stuff down and ban her, not because she couldn't afford it. Just my opinion.

one thing i do hope for..is that when Gala does win this..
there is a big pain and suffering and damages settlement that gets awarded to Gala..

i hope Gala's lawyer takes notice and slams the crap out of hush with a big one counting every cent and all the current and past evidence that is happening right then and now ..from the destinations guide showing her skins being advertised by hush all the way to having a hard time paying the electric bill.
plus all the mental stress and anything that can be thought of and recorded..

if there ever were a case with major damages to a creator..this one should be poster boy for SL content creators to always look back on..
i hope Gala gets back as much as possible in all this..and then in some way shows the community that yes it is worth it in the end..
yes it is worth standing up and fighting these people that steal..
it may not be an easy road..but in the end it is worth it in more ways than one..
file a dmca and follow it through from start to finish..don't just settle for content removal..be like a tiger protecting it's zone..another tiger walks in..
run them out and don't stop until you have pounced the crap out of them letting them know they better ask next time..

i really feel we are going to see a message sent when Gala wins this thing..and i really feel that things are going to change around here..
that we may see more serious cases getting filed and fully seen through by content creators..

and that's going to send a message to those that steal..don't freaking steal or you may end up like hush..broke more ways to sunday than can be counted..

i am a big believer in what goes around comes around or karma or whatever it is..
and with so much support..this is the outcome i see and believe in when it all comes out i the wash..
content creators need to know it is worth it to stand up..
i hope that gets sent more than anything..

one thing is for sure..Gala has to really feel good about how much support there is..that has to be a big thing helping deal with something like this..

Look you´ve been in this this thread trowing one liners, and being general insulting, including acusing a poster of being someone´s alt, and beating up their kids, in the meanwhile, me, eku, chandra, and a few other people have been showing and talking about how creators can actually, not only protect themselves, but also their work, and now you´re doing the haters gonna hate thing, so honestly fuck off, or at least try and understand the difference between learning something from your mistakes and improving, or in this case others mistakes, and if you do have something to tell me to fuck off on, at least try and do it in a full sentence.

Here is the thing Joy and why this does not work, there is due process, and laws, which we all must follow, imagine you´re driving down a street, and i hit you with my car it was my fault, but even not being your fault, you have to file up all the insurance paperwork, you need all your paperwork properly filled, it doesn´t matter if it was my fault, all the due process must be complete.
It´s that same due process that protects you when false claims are made against you.

Pointing out that things would have been easier if Gala had protected her stuff to begin with is not wrong in any way but a simple fact. Unlike you who has nothing to loose i post here under my SL name i do have my own reputation to uphold, everyone who knows me, knows how i feel about these issues, and how many times i have defended content creators here, they also knows i would not let something that i believe to be false, to slip tru. There are questions here that are relevant to everyone here that produces content, and we **cant get those answers without asking questions**.

Im going to go over that again, because I'm using more that four words to say it, and I have seen how that confuses you:

We that produce content need to know how, if at all, we can protect ourselves against finding ourselves in this same scenario.

This information cannot be obtained without analyzing the current situation with Gala for different choices along the way that might have led to a different result.

This is not the same as blaming her- this is people trying to understand how not to get *themselves* in the same situation one day. Because everything trends in sl, it may be information we need should stunts like this become the new way to grief someone.

Now, let me repeat this again in slightly different words:

It is protecting themselves.

As for Ely, she is sincere and heartfelt and a valued member of this community.
