Canada's various provinces have their own courts, differently organised in different places. I've only had a quick look, but the Supreme Court of British Columbia, for example, certainly seems to hear this sort of case.

According to the Hush website it's an interlocutory injunction, which I take to mean that the full case has yet to be heard, but Curio are banned from selling the skins until it is.

That's the idea I've gotten, but I also heard 3rd or 4th hand that a person messaged "Gala Phoenix" and they said Curio wasn't shutting down or anything, so it's weird that this is all going on.

All I know is that their hair company has the crappiest customer support, and that I'll never shop there again.

Curio skins? I've got some, and I've seen no sign of any sort of 'signature.' I'd need to see two texture files in the same shades to be able to say for sure, and that's not likely to happen.

Speculation ofc, but they could be just throwing in the towel to avoid a court case and/or embarrassment.

If there is enough concrete evidence for the court to issue an injunction, the skins will be the last of their worries. Misfiling a counter to a DMCA is perjury.

My skins started out with various layers from Eloh and Evana. I can always tell when someone else is doing the same.

It looks to me like both parties are using the same base texture. This is just my opinion, but unless the base texture for the Hush skins is something they made on their own, (like using their own bodies) this is all bullshit. I'm sure they'll both have to provide their PSD files to the court, and I bet this will all be over quickly.

Actually - as sad as it is - I wouldn't even dare to recommend touching either party with a stick, let alone get any new skins from either one until this is resolved.

True. That's what some fangirls/-boys fail to understand when they cry for such nonsense like "let the public be the judge"... yeah, preferably with 256 colours, 320x280 animated gifs or similiar crap as a basis.

Last time this kind of drama happened it turned out they were based off the same model photographs.

Who knows about injunctions? They must have had an acceptable level of evidence to get a judge to agree. Would Curio have had a chance to respond? As far as I am aware it is only an accusation at this stage and an injunction is a block until more legal action is taken.

So I've looked again - Let's see - Curio skins do not [or at least didn't] come with the cleavage, and they also look fresh and natural. The pictures of the hush skins on their own blog look well, pretty awful, and do have the cleavage.....

I think this is like the TSR suits of the 80-90s - the judge involved knows jack all about the subject and so is erring on the side of the claimant.

I looked at the side by side Flikr photos and most of the Hush skins look like a smeary version of the Curio skins, especially the one with the belly button.

But I might be biased, all I wear is curio and if they're gone from my inventory when I can manage to log back on I'm gonna be pissed beyond measure!

Of course I wouldn't want anyone's copyright and/or intellectual property infringed. But to be honest - it's hard to imagine all Curio skins removed from the grid, the repercussions would be dramatic. It's not only about popularity of the Curio brand, but also about hundreds and hundreds of real life dollars/euros/whatnot many customers would see going poof, which won't make the Hush-creator win many friends.
Seems there are no winners here.

personally, i have a very hard time believing this, at all.

from what i know of gala both from personal experience and others who know her, she isn't the sort who would go about blatantly ripping others off in this fashion.

and yeah.. the side by side images are pretty damning but, uh. kinda towards the wrong person. the hush skins look much more like the derivative work in said photos.

i'll withhold any further comments . opinion but the whole thing is sketchy as hell, right now and i'm highly dubious of any claims going out against curio.. .

If you look at the Curio skins, you can kind of tell they're from a photosource, and the Hush ones look like the same, only with heavy use of the blur and smear tools.

But, that's for a judge to decide now. I sure hope whoever makes the determination has at least a basic knowledge of the Photoshop tools though.

Whoa! If true, that is huge. And sad. If SL removes all of Curio's skins, I will be out approximately half a shit-ton of money spent on those skins.

If her skins really have been ripped off by Curio I feel bad for her. I actually have never heard of her skin line and always hear of Curio. Did she not know this was happening all this time, or was it all tied up in court that long, I wonder.
