Neil banned from blogger

I highly doubt he deleted his account. However, after just reposting another strand of stolen bloodlines code, his blog is gone.

Curious:

Is every alt / new account LLs knows belongs to him auto-banned, or do they just keep letting him in until he once again proves himself?

Ie: is it that they can't find him, or that they keep giving him another chance?

This is true.... but you know how my mind works - I'm not thinking of the future, or the other services, or even an end to his shenanigans.

I'm thinking of the guy that wakes up to see what adulation has accumulated overnight to see the 'fuck off' message.

That to me is just a lil slice of heaven.

If they're doing to him what they did to me up to six months ago, they're autobanning him after 12 hours of having an account unless he does something sooner.

I had a random thought...

Why don't they sue him?

Cease and Desist order, followed by a suit for interference with contract - its an amazingly nasty tort. Couple it with whatever suits the music industry has been using against people using peer-to-peer downloads of music. Those music people have managed to win multi-million dollar judgments against people who'd just grabbed a few napster things here and there.

You could hold Neil liable, financially, for every single case of copy-theft ever done using a client he put out.

Plus additional punitive damages for the intentional nature of his attempts to defraud LLs and all of us.

LL's is not as big as the music industry by any stretch, but surely they could have their lawyers drop a dime on calling the record label lawyers and asking for a little advice.

because up till the new rules he just made the "gun" and it was not illegal to make "guns"... and other people were using his "weapons" to rip people off in SL ...

just like in RL you cant sue Remington if someone uses one of thier guns to rob your store.

but now with the new rules maybe they can nail him... Blizzard did it to the guy who wrote Wow-Glider.... I would have like to have seen his face when the lawyers showed up at his door.

I'm getting really tired of random people IMing me asking for "banned" clients. Like CyroLife and NeilLife. I'm glad his blog got shut down!

If LL knows who "Niel" is and he is accessing the Linden Research Inc. network without authorization then Kingdon could be a real dick and have the kids ass put in prison to chill out and make new boyfriends for a while. Just to make an example of how serious business LL is.

You can see LL isn't doing anything of the kind. So whatever. Business as usual.

Removing permission checks is as hard as commenting out a line of code. NeilLife is just a pathetic collection of silly hacks compiled by a 13-year-old. He probably gets most of that stuff from other people, if you have ever seen his own source code (he hasn't published source since months though) you will agree.

Actually you generally can. But guns tend to have exceptions specifically carved out for them in the law. That said, some gun makers -have- been sued when they put out guns that were not reasonably for any use other than against other human beings. Such suits have not yet been upheld, but I believe they have lost at trial and lower level appeals (need to fact check that though).

Guns are never a good analogy - because the NRA and popular conceptions of the second amendment makes even legislators and judges shy of taking them on.

Makers of products designed to do harm - either physical or economical - other than guns - which have no reasonable non-harmful uses, have routinely been successfully sued.

Also, keep in mind that LLs has no power over law. Just because it is in or out of the TOS has all of zero impact in law. Just because the TOS doesn't say you can't do it, doesn't mean you can't get in legal trouble for doing it. And likewise, if conduct is illegal but allowed in the TOS, you still can't legally do it.

So LLs updating their TOS has no more effect that putting people on clearer notice of prior existing facts.

Find me one criminal law Niel has violated. One.

He might be liable for a whole lot of civil violations, but there's not one criminal violation in all of this copybotting stuff that I can see.

They can sue the heck out of him, and maybe even win, but Kingdon is not armed with the police powers of a governmental body.


Think carefully about what a copy-theft does before jumping to a conclusion here: It doesn't take the item from you, it steals nothing. It makes a duplicate - it deprives you of an economic opportunity. That's a civil violation, not a criminal one. The remedy is getting the value of your lost business opportunities back from the person who caused you to lose those sales.
