The ref to SCO was also great. Thanks for the memories on that one. At one point my former employer, meaning ME, had to "disempartner" from them as a sponsor because of this same kind of shenanigan...

I'd never buy from this person now because they clearly have an "if I like you" policy on what they do with their customers. Would be nice if they'd stop punishing people who did no wrong...

At least you got the last part right, but you are still only making an assumption about the first..

Linden Lab's ToS for Second Life does not extend beyond LL services.. Therefore, posting IM, chat, or otherwise private conversations on this, a third party site not connected to LL, is in no way, shape, or form in violation of LL's ToS.

In order for you, your lawyer, or anyone else to have content removed from LL's services, a DMCA would have to be filed. LL does not even have to honor a C&D without the propper DMCA paperwork. That said, saying that you notified her of a DMCA takedown, is not to far from the truth. Your terminology may have been different, but your intentions were the same.

I never saw where she was badmouthing you, or even trying to make it look as if you were being the 'bad guy', could you quote that for me please? As a side note, IMO you, have so far, done a fine job making yourself look bad.

Again, read my response above, and as far as extortion goes, when did she ask you for money or compensation? I must have missed that part as well, can you please quote that for me along with the other part?

Thanks..

Ok thanks for explaining the Tos thing and third party sites and the cute skydiving stuff. :-) Learn something new every day.

I'll post the entire offline I sent to her.

[2008/10/03 14:24] Vryl Valkyrie: I would like to ask you to please buy a legal version of these textures when you get a chance.. they are 8000 lindens .. here is my land mark and the textures are called marlin studios ornament
[2008/10/03 14:24] Second Life: User not online - message will be stored and delivered later.
[2008/10/03 14:27] Vryl Valkyrie: For the Josef tear textures, those are free but you need to give credit in your build who created the textures as it says in the license
[2008/10/03 14:27] Second Life: User not online - message will be stored and delivered later.
[2008/10/03 14:44] Vryl Valkyrie: For the record, we plan to have these textures removed the database in the upcoming months so I would recommend to retexture with the legal versions asap
[2008/10/03 14:44] Second Life: User not online - message will be stored and delivered later."

As you can see here, I was far from rude or threatening. I redirected her to the SLNN story because it was the best way to explain the textures and TRU's illegal use of them.

I did not demand or threaten but did suggest when she has time to buy the legal versions. Gave her a LM and told her the price. That was not wrong.

I also mentioned for her own knowledge that we are working to have the UUID's removed from the database and she should retexture with legal versions. I think that was really nice of me.

I did mention that the Josef Tear textures she is using, she should be giving credit to the creator as stated in his license. Who knows, maybe she did not get them free and bought them from TRU.

What I resent most is her coming her to post when all she had to do was contact me. I am a very sweet person and would have worked something out. I also resent how she tried to make me look bad and even lie and take things out of context as some means of public shame and extortion.

I still think she should buy the textures. It is only right. I have also suggested to the creator of these textures, who was wrongly informed by Lillybeth Filth that it was ok for her to use these, to please refund the money she speant buying them in the first place. that is also only right.

Had this just been a regular resident who is not commercializing on the textures, this would be a different matter all together. The reality is that when we brought these textures into SL, we thought we were bringing something new to SL residents.. but infact, we find out many of the Marlin textures were here for years.

This is why there needs to be UUID removal. For example.. go to search, type in 10 000 .. you will find tons of this reference.. also filled with Marlin textures.. they have been raped, used and violated in any way possible.

It has lessened the value of the textures. Customers have actually told me that they were disappointed because they bought "freebie" textures.

So before you decide to burn us at the cross here, put yourself in our shoes first. We are not the bad guys. However, at the same time, we must also protect our intellectual property.

Hi Vryl! I am disgusted by all this myself but at Lilybeth and TRU because when people like her profit from ripped content from the web people like you and Isablan get caught in the mix while they just count the money and keep on being a weasel. I just wanted to comment on something real quick from the perspective of someone that read this thread but has nothing personal to gain from it.

I can TOTALLY see how you see it as an attack, but knowing Isablan from forums even before this one I can tell you that is not her style. I saw that post not as a catalyst to make you the "bad guy" but as a typical "Guys, I have an issue with ethical ramifications I need advice on." The ONLY person that looked like a bad guy was Lilybeth who must at this point be used to hearing it. I did not see Islaban say you threatened her with a DMCA but instead that she got from the IM a DMCA was likely in the works. Not against her.. but against the textures ripped by Lilybeth of Textures R Us (Tru) *hi goggle*

The TOS issue has been [RESOLVED] about posting chat logs as you can read above. Like it or not, it did add context to the discussion. Anyway, I am not against you here.. I just think you are seeing this through personal eyes and not seeing it as it looks to the rest of us. You did not appear attacked in the OP. This rang of the same old "TRU sold me ripped content and now what should I do with it to be ethical?" Except sprinkled with "Now the person who has license to these textures is asking me to stop and offering me the chance to buy her's instead." I hope that makes sense.

Now Isablan.. to your OP. I would let Vyrl keep on fighting the good fight against TRU and you keep on doing what you are doing but going forward not use the textures in future builds unless they are from the source (as you are negotiating now).
You have done nothing wrong nor unetical here. It sucks for you and Vyrl that Lilybeth from Textures R Us (TRU) ripped you off but I see no legal responsibility to retexture. This is now a legal and Linden matter and in the meantime all you can do is watch and wait and IF the textures go poof from the database (not likely as Lindens hate broken content and have done less about more before) then retexture with the new stuff and offer it to your past clients. Of course with a nice notecard explaining the gross lack of ethics of Lilybeth from Textures R Us (TRU) in selling them knowingly in the first place.

Satir DeCuir who sold her the textures and was working at TRU at the time has just paid me 8000 Lindens. She asked me to give Isablan a legal set of textures. Satir DeCuir was wrongly informed by Lillybeth Filth at the time that she can sell Marlin textures. She was also the copyright agent for TRU.

I would like to say that I have the upmost respect for Satir DeCuir for owning up to her mistakes and doing the right thing. That takes courage.

We all makes mistakes and hopefully can only grow and learn from them.

I am still disappointed with how Isablan has handled this situation and took things said out of context to make me look bad.. and yes that's exactly how I see it. However, I do forgive her. Well, hopefully we can all learn from this experience.

This would be you saying you were going to file a DMCA .. since that is the only way you can get those removed.

so what she said that you said is dead on accurate.

She did no such thing. If you choose to continue thinking so, that's your perogative, but you will be bitter and sullying your own reputation in doing so. Why should the victim be punished twice, considering her purchase was done in good faith? What kind of reputation does that generate for your own business? No one here is making you look bad except yourself.
